Are you an SME who uses subcontractors for your construction projects?
From time-to-time contractors may allege that there are defects present in the sub-contract works. The legal principle often brought to the fore in these circumstances is the contractor’s duty to mitigate their loss.
Changes to the Defective Premises Act 1972 and the Building Act 1984. The Building Safety Act 2022 is the Government’s response to the tragic Grenfell fire, and the first parts of the Act came into force on 28 June 2022.
It is not uncommon for roofing companies working as sub-contractors to a main contract to have problems obtaining the release of retention money from the main contractor. The retention amount should be specified within the sub-contract document and is usually set at 3% or 5% of the total work value.
